Civil Bailiff Department

The Civil Bailiff Department perfects service for legal civil documents. Bailiffs enforce civil orders, civil judgments, and execute writs as required by the Ohio Revised Code and Local Court Rules. The department also supervises evictions and executes judgments and replevins according to a court order.

Bailiff Sale

A Bailiff sale is a legal tool used under the umbrella of an execution where the Civil Bailiff Department seizes the property of a defendant and offers it for sale at a public venue. There are currently no scheduled bailiff sales.

Evictions

An eviction is the process used by landlords to recover possession of leased rental property from tenants who refuse to leave voluntarily. In order to complete a court-ordered eviction, the plaintiff will be required to provide the following:

  • 4 physically capable people (suggested age 18 or older) who all must be able to move/lift heavy furniture and/or appliances and be able to navigate stairs.

  • An ample supply of sturdy cardboard boxes and contractor bags sufficient to contain the belongings of the unit.

  • Appropriate tools to: change locks, disconnect appliances, or disassemble furniture.

  • Tarps and/or rolls of plastic to protect items placed outside. (Applicable only during inclement weather.)

  • Towing and storage of any vehicles left on the property at the time of the eviction.

Any unattended prescription drugs and/or firearms discovered at the time of the eviction will be turned over to the Deputy Bailiff for appropriate safekeeping and/or destruction.

Any unattended animals discovered at the time of the eviction will be surrendered to the appropriate animal welfare agency.

Execution

A Writ of Execution is a legal tool used by a plaintiff to attach defendant’s assets to satisfy a judgement. The Civil Bailiff Department will attempt to collect payment for judgement rendered, or seize assets to satisfy said judgement through a Bailiff’s Sale.

Garnishment

A garnishment is a court-ordered method of collecting money directly from a person's wages or bank account. The process is one by which a judgment creditor seizes money owed to the judgment debtor from a third party known as a "garnishee."

When filing a garnishment you must ensure you use the correct address for the employer or bank.

Replevin

A Writ of Replevin is a post-judgement action to return property to the owner as decided by the court. The Civil Bailiff Department arranges for peaceful transfer of the property to said owner.
