ADA Policy
The Americans with Disabilities Act of 1990 (ADA) and the ADA Amendments Act of 2008 (ADAAA) identify the responsibilities of courts under Title II to provide access for citizens with disabilities to programs and services offered by public entities, including courts. Ohio courts have an obligation to take proactive steps to remove barriers to accessibility for people with disabilities. More than one in four adults in the United States have some type of disability.
The Toledo Municipal Court remains committed to open access to judicial services. A person requiring special accommodations to appear in court shall notify the court as soon as possible, but no later than 48 hours, before the scheduled appearance event. This time gives the court the opportunity to determine reasonable accommodations.

Upon request, the Toledo Municipal Court will attempt to provide appropriate aids and services for the effective communication so qualified persons with disabilities can fully participate in the Court's services, programs, and activities. This includes qualified sign language interpreters, and other ways of making information and communications accessible to people who have speech, hearing, or vision impairments. Grievance and Appeal Procedure
The ADA does not require the court to take any action that would fundamentally alter the nature of its programs or services, or impose an undue financial or administrative burden.
A grievance is a complaint, or a request for review, alleging that the Toledo Municipal Court is noncompliant with the provisions of the Americans with Disabilities Act.
This grievance procedure below is established to meet the requirements of the ADA. It may be used by anyone who wishes to file a complaint alleging discrimination on the basis of disability in the provision of services, activities, programs, or benefits.

The complaint should be in writing and contain information about the alleged discrimination, such as the name, address, and phone number of the complainant and the location, date, and description of the issue. Alternative means of filing complaints, such as personal interviews or a tape recording of the complaint, will be made available for persons with disabilities upon request.
The complaint should be submitted by the complainant or the complainant’s designee as soon as possible but no later than 60 calendar days after the alleged violation to:

Within 15 calendar days after receipt of the complaint, the ADA Coordinator or the coordinator’s designee will meet with the complainant to discuss the complaint and possible resolutions. Within 15 calendar days of the meeting, the ADA Coordinator or the coordinator’s designee will respond in writing, and where appropriate, in a format accessible to the complainant, such as large print or audio tape. The response will explain the position of the Toledo Municipal Court and offer options for substantive resolution of the complaint.
If the response by the ADA Coordinator or the coordinator’s designee does not satisfactorily resolve the issue, the complainant may appeal the decision to the Presiding Judge or Presiding Judge’s designee within 15 calendar days after receipt of the response.
Within 15 calendar days after receipt of the appeal, the Presiding Judge, or the Presiding Judge’s designee, will meet with the complainant to discuss the complaint and possible resolutions. Within 15 calendar days after the meeting, the Presiding Judge or Presiding Judge’s designee will respond in writing and, where appropriate, in a format accessible to the complainant with a final resolution of the complaint.
All written complaints received by the ADA Coordinator or the coordinator’s designee, and/or appeals to the Presiding Judge or Presiding Judge’s designee, and responses from those offices will be retained by the Toledo Municipal Court for at least three years.
