Exhibit Return
After a court case is over and the 40-day appeal period has passed, exhibits (evidence used in the case) can be returned to the person who gave them to the court or to their attorney. Exhibits submitted after April 1, 2025 will be destroyed one year after the expiration of the appeal period. To request exhibits back, follow these steps:
Submit a Motion
Pursuant to the court's Exhibit Policy, you must file a motion online or in person with the court to ask for the return of exhibits.
E-File
Motion forms and instructions for filing online (e-filing) are available on the Clerk of Court's website.
OR
File In-Person (if not e-filing)
Take your motion to the correct office:
Criminal/Traffic cases: First floor of The Toledo Municipal Court building
Civil/Small Claims/Evictions (FEDs): Basement level
After a Judge Approves the Motion
If the judge grants your motion, you must arrange a time to pick up the exhibits. Contact Meredith Kurucz at (419) 245-1879 or by email at meredith.kurucz@tmcourt.org to schedule pickup.
Sign the Release Form
When you pick up your exhibits, you or your attorney must sign an exhibit release form.
Who Can Pick Up Exhibits
Only the person who submitted the exhibits or their attorney can receive them.

Exhibits will not be mailed.
